I-540 Attacker Update
The alleged I-540 rapist I posted about last year has been found competent to stand trial. To refresh everyone's memory about this lowlife, here's what happened:
McCarter allegedly followed an 18-year-old Fort Smith woman and a 19-year-old Barling woman at about 2:30 a.m. from Dickson Street in Fayetteville onto I-540 south, according to a police report. After following them for a few miles, he rear-ended their vehicle near Winslow, causing their car to crash into the median, police said.
The women told police the suspect approached one of them and carried her to the west side of the road and attempted to rape her, according to a police report. Police said the other woman attempted to call the police on her cell phone, but she was stopped by the suspect who came after her and raped her.
Two passing motorists stopped and rescued the women and subdued the suspect until police arrived.
His defense appears to be that he was drunk and the girls were lying.
In the evaluation, McCarter stated that he didn't remember what happened that night. He said he was intoxicated and had a confrontation with a bouncer in the Fayetteville area earlier in the evening and when police came to the bar, they transported him to his friend's house.
He then went back to get his car at the bar after being dropped off at his friend's and was on his way to Fort Smith, but the next thing he remembered was waking up in jail, according to the evaluation.
McCarter stated in the evaluation that the women wrecked their car and that his car had no damage. He believed the women made up the rape story to get them out of trouble with their family for being out late and wrecking the car. He said the women lied because they were drinking under-age at the bars.
Hate to burst your bubble there bucky, but voluntary intoxication is not a valid defense in Arkansas....and no jury is going to buy that those two guys stopped & beat the crap out of you for no reason.
